1. OVERVIEW

This Cancellation & Refund Policy applies to all coaching services, memberships, subscriptions, digital products, training programs, nutrition programs, challenges and related services provided by Built By Chocky and Mac Coaching Pty Ltd.

By purchasing any service, you agree to this Policy.

2. MINIMUM COMMITMENT PERIOD

All coaching subscriptions are subject to a minimum commitment period of twelve (12) weeks.

The minimum term begins from the date your subscription commences.

By enrolling in a coaching service, you agree to remain financially responsible for the minimum commitment period regardless of:

• Personal circumstances
• Motivation levels
• Changes in goals
• Travel commitments
• Work commitments
• Failure to engage with coaching
• Failure to complete onboarding
• Failure to submit check-ins

Cancellation during the minimum term is not permitted except where required by Australian Consumer Law.

3. CANCELLATION OF COACHING SERVICES

Following completion of the initial 12-week commitment period, members may cancel their coaching subscription by providing a minimum of four (4) weeks written notice.

Cancellation requests must be submitted via email to:

Notice periods commence from the date written notice is received.

Verbal requests, social media messages, text messages, or requests submitted through third parties will not be accepted as cancellation notice.

4. PAYMENTS DURING NOTICE PERIOD

All payments falling due during the four (4) week cancellation notice period remain payable.

For example:

If your next subscription payment is due on Monday and you submit your cancellation request on Tuesday, your subscription will remain active during the notice period and any scheduled payments during that period will still be processed.

5. NON-PAYMENT OR FAILED PAYMENTS

Stopping, reversing or disputing payments does not constitute cancellation.

If a payment fails or is reversed:

• Coaching services may be suspended.
• App access may be suspended.
• Community access may be suspended.
• Outstanding balances remain payable.
• Recovery action may be taken where necessary.

6. REFUND POLICY

Unless otherwise required by Australian Consumer Law, coaching services are non-refundable.

Refunds will not be provided for:

• Change of mind
• Lack of motivation
• Failure to follow the program
• Failure to complete onboarding
• Failure to submit check-ins
• Missed coaching opportunities
• Unused services
• Travel commitments
• Work commitments
• Personal scheduling conflicts
• Dissatisfaction caused by failure to follow coaching recommendations

7. DIGITAL PRODUCTS

Digital products, including but not limited to:

• E-books
• Training programs
• Nutrition guides
• Educational resources
• Downloadable content

are non-refundable once access has been granted or the product has been delivered.

8. EXCEPTIONAL CIRCUMSTANCES

Built By Chocky may, at its sole discretion, consider requests for:

• Membership pauses
• Early cancellations
• Account credits

in exceptional circumstances including:

• Serious illness
• Significant injury
• Military deployment
• Extreme personal hardship

Supporting documentation may be requested.

Approval is entirely at the discretion of Mac Coaching Pty Ltd and is not guaranteed.

9. MEMBERSHIP HOLDS

Where approved, memberships may be placed on hold for a specified period.

Membership holds:

• Are not available during the initial 12-week commitment period unless approved under exceptional circumstances.
• Must be requested in writing.
• May require supporting documentation.

10. AUSTRALIAN CONSUMER LAW

Nothing in this Policy excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

If a major failure occurs in relation to a service provided by us, you may be entitled to remedies available under the Australian Consumer Law.

11. CHARGEBACKS AND PAYMENT DISPUTES

Where a chargeback or payment dispute is lodged:

• We reserve the right to suspend coaching services immediately.
• We may provide copies of agreements, policies, payment records and onboarding documents to the relevant financial institution.
• Any outstanding obligations under the coaching agreement remain enforceable.
